General Terms and Conditions

1. scope of application

The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.

2 Contractual partner, conclusion of contract

The purchase contract is concluded with Happy Sprinkles GmbH.

The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. By clicking on the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been sent.

The date on which the contract with us comes into effect depends on the payment method you have chosen:

credit card

When you place your order, you also send us your credit card details. After you have been legitimized as the legal cardholder, we will ask your credit card company to initiate the payment transaction and thereby accept your offer.

PayPal, PayPal Express

During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the store, we request PayPal to initiate the payment transaction and thereby accept your offer.

Immediately

After placing the order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. This concludes the contract with us.

3. contract language, contract text storage

The language available for the conclusion of the contract is German.

We save the text of the contract and send you the order data and our GTC by e-mail. For security reasons, the text of the contract is no longer accessible via the Internet.

4. terms of delivery

Shipping costs may apply in addition to the indicated product prices. You can find out more about any shipping costs in the offers.

We only deliver by mail order. Unfortunately, it is not possible to collect the goods yourself.

5. payment

The following payment methods are available in our store:

credit card

When you place your order, you also send us your credit card details.
Once you have been legitimized as the legitimate cardholder, we will ask your credit card company to initiate the payment transaction immediately after you place the order. The payment transaction will be carried out automatically by the credit card company and your card will be debited.

PayPal, PayPal Express

During the ordering process, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, legitimize with your access data and confirm the payment instruction to us. After placing the order in the store, we request PayPal to initiate the payment transaction.
The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Immediately

After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort, legitimize yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

6. subscription "Happy Backbox"

The Happy Backbox (hereinafter referred to as the "Backbox") is a fee-based and continuous Subscription with three different terms:
  • Minimum purchase of one box (trial subscription)
  • Minimum purchase of three boxes in a row (Enthusiast subscription)
  • Minimum purchase of six boxes in a row (Baking Lover subscription)

Once the minimum term has been reached, the subscription is extended by a further Backbox until notice of termination is given. The Backbox is sent out every two months, starting on the 1st of every even month. The Backbox is automatically debited on the 25th of an odd-numbered month. The exception is Easter Baking boxhere the debit and dispatch date varies depending on the date of Easter. There will always be a corresponding note in the February Backbox.

The customer must ensure that the payment and address details are always up to date. The change of address data must be communicated to us by e-mail or letter. For this purpose, the customer can send an e-mail to [email protected] or a letter to Happy Sprinkles GmbH, Stresemannallee 88, 22529 Hamburg. If the customer unilaterally initiates a return debit note or a repeated debit attempt is unsuccessful, we reserve the right to charge additional reminder fees.

Cancellation must be submitted in writing at least one day before the debit is made. This can be done either by signed letter to Happy Sprinkles GmbH, Stresemannallee 88, 22529 Hamburg, Germany, or by e-mail to [email protected]. If the cancellation is submitted by email, the email address used must be the one provided when the subscription was taken out. The date of receipt of the e-mail or letter is decisive. If the customer has an active user account at Happy Sprinkles , the subscription can also be canceled via the user account. The unilateral stopping of the direct debit authorization by the customer does not constitute termination.

7. reservation of title

The goods remain our property until full payment has been made.

8. transportation damage

If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.

9 Warranty and guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
The following applies to used goods: if the defect occurs after the expiry of one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
The above restrictions and shortened periods do not apply to claims based on damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, limb or health,
  • in the event of intentional or grossly negligent breach of duty and fraudulent intent,
  • in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the framework of a guarantee promise, if agreed or
  • insofar as the scope of application of the Product Liability Act is opened.

Vouchers

Vouchers in the form of value vouchers do not have a general limitation period and are therefore unlimited in time. Please note that a voucher may not be purchased with a voucher. However, should this occur, we reserve the right to cancel the order.

10. liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, limb or health,
  • in the event of intentional or grossly negligent breach of duty,
  • for guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

11. dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
